SJC Rules that Same-Sex Couples Have Same Standing In Child Custody Disuptes

February 3, 2012 - John R. Ellement - Boston Globe, Metro Section

The Massachusetts Supreme Judicial Court ruled that same-sex couples have equal standing when child custody disputes arise. The SJC confirmed that because the couple were married when the child was born, that child will be the legitimate child of both parents and the law now gives each parent equal legal standing in child custody proceedings. The Massachusetts Trial Courts Funding Crisis

For further reading click here to go to the Massachusetts Bar Association web site.

Our court system should be a source of pride.  It is, after all, a model for many other countries looking to improve their judicial system and many United States Supreme Court cases have been cited internationally.  The Founding Fathers made the rule of law a priority holding it out as a way to thrive and achieve the common good they sought for the future.

Our courts impact us all on a daily basis; even when we do not realize it.  The courts are where we go to fight back government encroachment on our civil rights.  The courts uphold our right to fair labor standards and levels the playing field when we negotiate employment contracts with behemoth corporations.  From the time we wake up until the time we go to bed, the laws and the court system have been quietly operating in our lives.

Unfortunately, the Massachusetts Trial Court system has been facing budget cuts that make delivering service extremely difficult.  Over a million new court cases are filed each year in the Massachusetts Trial Court system.  But yet, our courts have been asked to continue their Constitutional duties with $46 million dollars less since 2009.  The result has been 1,270 less court employees (since 2007) to help and process your case. See the pdf on these figures by clicking here.

As the Fiscal Year 2013 budget proposal is being prepared by Governor Patrick and our House and Senate officials, we must act as the squeaky wheel to ensure our access to justice is not denied; either outright or by long delays.  The rule of law, and our ability to seek equality through the courts was of great importance when this country was founded.  It is no less important today.

Please take the time to click here and learn who your representative is.  Drop them an e-mail or letter letting them know you care about having access to justice that can only be guaranteed with proper funding.  The Massachusetts Bar Association has produced two video clips (see below) that help explain the situation.
